One really has to wonder what would become of the unfortunate lawyer making such a gesture before a High Court Judge - anyone for Belmarsh?!
The question will never arise. Barristers are such well bred gentleman (even the ladies) the judge can sit on the bench without fear.
Unless, that is, a solicitor inadequate appears before him: these are a rough cut bunch who rarely shave (yes, even the ladies) or change their underwear (yes even [etc]) or bother to read the case papers. Invariably they are also drunk and/or high on drugs. All bets are off with a solicitor inadequate.
