Following closely in the wake of Bunt v Tilley comes yet another online defamation case: Smith v Williams in which a right wing loony (UK Independence Party - natch) wins against a left wing loony. As with Bunt the facts and conclusion are pretty straightforward: someone assuming that the Internet gave them anonymity to defame & learning that discovery tore away the veil. Smith considered suing Yahoo! but declined because of their US jurisdiction. Geeklawyer suggest that this was a rather conservative (ahem, sorry) strategy and that they could, nonetheless, have been entangled as a defendant with deeper pockets.
Still, it was all a bit like seeing Tony Blair in a knife fight with Margaret Thatcher: which would you want to see die if you could only choose one? tough choice eh!
